An article submitted by Daigle, Fisse & Kessenich attorney Kirk N. Aurandt entitled “The Legal Story of the Pennsylvania: A Forward-to-Aft Inspection of a Landmark Admiralty Case” was published in the July 2014 issue (Volume 45) of the Journal of Maritime Law and Commerce.” The article—through an examination of the pleadings and the evidence found in the court record, and a discussion of the opinions handed down by the federal district court, circuit court, and U.S. Supreme Court—tracks the legal journey of The Pennsylvania, 86 U.S. (19 Wall.) 125, 1998 A.M.C. 1506 (1873), from the immediate aftermath of the 1869 collision between the steamship Pennsylvania and the sailing bark Mary A. Troop to the pronouncement of the famous “Pennsylvania Rule” by the Supreme Court of the United States.
